Terms of Use for the NianiaLog Application

1. General information

1. These Terms of Use define the rules for using the NianiaLog application.

2. The operator of the application is Paweł Borkowski conducting business under the name Paweł Borkowski BrainHatchery, ul. Jemiołowa 44/107a, 53-426 Wrocław, NIP: 6151878784, REGON: 367951024.

5. Using the application means accepting these Terms of Use and the Privacy Policy.

2. What NianiaLog is

1. NianiaLog is an application that helps a parent and a nanny keep a simple childcare log, record working hours, settlements and a list of duties.

2. The application enables, in particular:

   • recording daily entries such as milk, breastfeeding, meal, nap, poop and note,
   • planning and approving the nanny’s working hours,
   • keeping auxiliary monthly and hourly settlements,
   • defining the nanny’s duties,
   • inviting a parent, second parent and nanny to a shared family in the application.

3. The application is an organisational tool. It is not a medical system, medical documentation, HR system, accounting system or a tool for formal employment settlement.

4. Information and calculations visible in the application are auxiliary in nature. Users are independently responsible for their legal, tax, HR, contractual and organisational arrangements.

3. Definitions

1. Application – the NianiaLog application available as a web/PWA application and possibly as a mobile application.

2. Operator – Paweł Borkowski BrainHatchery.

3. User – a person using the application, in particular a parent, second parent or nanny.

4. Parent – a User who creates a family in the application or is invited to it as a second parent.

5. Nanny – a User invited by a parent to a family in the application.

6. Family – a space in the application where a parent, second parent and nanny may keep entries related to childcare, working hours, settlements and duties.

7. Child – a child indicated by a parent in the application. The child may be identified by a first name, pseudonym or another name chosen by the parent.

4. Account and access to the application

1. A User account is required to use the application.

2. The account is created using an e-mail address.

3. Login takes place using a one-time code or another mechanism available in the application.

4. The User should protect access to their e-mail inbox and to the device on which they use the application.

5. The application is intended for adults. If a minor is to use the application, this requires the consent and responsibility of their legal guardian.

5. Roles in the application

1. A Parent may create a family in the application.

2. A Parent may invite a second parent and a nanny to the family.

3. The Nanny gains access to family data to the extent necessary to use the functions of the application.

4. A Parent may manage the access of family members, including deactivating the access of a nanny or second parent.

5. The User should not share invitation codes with unauthorised persons.

6. Data entered into the application

1. The User is responsible for the content and data they enter into the application.

2. The application does not require providing:

   • a PESEL number,
   • residential address,
   • phone number,
   • photos,
   • documents,
   • bank details,
   • medical documentation.

3. A Parent may identify a child with a pseudonym or shortened name.

4. The User should not enter into the application medical data, diagnoses, test results, medical documentation or other information that is not necessary for the daily organisation of care.

5. Entries such as feeding, meal, nap, poop or note are used only for the ongoing organisation of care and communication between the parent and the nanny.

7. Hours, settlements and duties

1. The application enables recording the nanny’s planned and actual working hours, breaks, working days and days off.

2. A Parent may approve or reject the nanny’s working hours.

3. The application may calculate auxiliary amounts to be paid based on data entered by Users.

4. Calculations in the application are not an accounting document, bill, invoice, payroll list or official confirmation of salary payment.

5. The Parent and the Nanny independently agree on the rules of cooperation, remuneration, contract, taxes, contributions and other legal obligations.

6. The application enables creating and accepting a list of the nanny’s duties. The list of duties in the application does not replace a formal agreement between the parent and the nanny.

8. Rules for using the application

1. The User undertakes to use the application in accordance with the law, the Terms of Use and the purpose of the application.

2. The User must not:

   • attempt to gain access to data of other families,
   • interfere with the operation of the application,
   • enter unlawful, offensive content or content infringing the rights of other persons,
   • enter data that the application does not require, in particular photos, documents, PESEL numbers, addresses, bank details or detailed medical information.

3. The Operator may take technical or organisational actions in the event of abuse, in particular restrict access to the application or remove content violating the Terms of Use, if this is justified and compliant with the law.

9. Availability of the application

1. The Operator makes efforts to ensure that the application works correctly.

2. The Operator does not guarantee uninterrupted availability of the application.

3. The application may be temporarily unavailable due to technical work, failures, updates, actions of external providers or reasons beyond the Operator’s control.

4. The Operator may develop the application, change its functions, remove unused functions and add new functions.

10. Fees

1. As of the effective date of the Terms of Use, the application is free of charge.

2. The application has no paid functions, subscriptions or paywall.

3. If paid functions or a premium version appear in the future, their rules will be described separately or in updated Terms of Use.

4. Any voluntary support for the development of the project, if introduced, will not unlock application functions unless expressly stated otherwise in separate rules.

11. Account and data deletion

1. The User may delete their account independently in the application.

2. Deleting a nanny account results in deletion or deactivation of the nanny’s access to families. Historical family data may remain available to parents if this is necessary to preserve the history of entries, hours, settlements or duties.

3. Deleting a second parent’s account results in deletion or deactivation of that person’s access to the family. The family remains available to the family owner.

4. If the account is deleted by the family owner and there is an active second parent in the family, the second parent may become the owner of the family.

5. If the account is deleted by the only parent who is the family owner, deleting the account may result in deletion of the family and its data, including children’s data, daily entries, working hours, settlements, duties and invitations.

6. Deleting an account or family may be irreversible.

12. Complaints and reports

1. The User may submit a complaint or report a problem concerning the operation of the application to: kontakt@nianialog.pl.

2. The report should include a description of the problem and an e-mail address allowing return contact.

3. The Operator responds to reports within a reasonable time, usually no longer than 14 days from receipt of a complete report.

13. Liability

1. The Operator is liable towards the User in accordance with applicable law.

2. The Operator is not liable for:

   • data and content entered by Users,
   • arrangements between the parent and the nanny,
   • decisions made by Users based on data from the application,
   • correctness of settlements if they result from data entered by Users,
   • lack of access to the application resulting from reasons beyond the Operator’s control,
   • loss of access to the account resulting from the User losing access to their e-mail inbox.

3. The application is an auxiliary and organisational tool. It does not replace legal, tax, medical, accounting or HR advice.

14. Changes to the Terms of Use

1. The Operator may change the Terms of Use, in particular in the event of:

   • changes to application functions,
   • changes in law,
   • changes to the Operator’s data,
   • the need to clarify the rules for using the application,
   • security reasons.

2. The User will be informed of material changes to the Terms of Use in the application or through another appropriate channel.

3. If a change requires renewed acceptance, continued use of the application may require accepting the new version of the Terms of Use.

4. A User who does not accept the changes may stop using the application and delete the account.

15. Final provisions

1. The Terms of Use are governed by Polish law.

2. In matters not regulated by the Terms of Use, applicable provisions of Polish law apply.

3. The Terms of Use are available in the application and may be available on the NianiaLog website.

4. If the Terms of Use are available in several language versions, the Polish version is the primary version.
